I lodged an IC review application over a year ago – when will it be finalised?
The OAIC apologies for the delay in considering your IC review application. The OAIC is currently prioritising the following applications:
- IC review applications received 2020 and 2021
- IC reviews applications involving deemed access refusals (where an agency has not provided a decision within the statutory processing timeframe)
- IC reviews where the respondent is a Minister
- IC reviews where the sole access refusal reason relates to:
- adequacy of searches (s 24A)
- imposition of a charge (s 29)
- practical refusal (s 24)
- secrecy provision (s 38)
- IC reviews of access grant decisions.
What can I do to speed up the process?
You can:
- Advise the OAIC of changes to your contact details
- Advise the OAIC whether you have any related matters in the Administrative Review Tribunal or the Federal Court; this will assist in considering whether your application should be considered directly by the Tribunal
- Respond promptly to the OAIC’s request for information (if you have received a request)
- Provide any recent correspondence with the agency or minister that may affect the scope of the IC review
- Make contact with the agency or minister to see if the matter can be resolved informally
I have multiple matters with the OAIC but I do not wish to pursue some these matters – what do I need to do?
You can:
- Advise the OAIC in writing that you no longer wish to continue with your IC or FOI complaint and provide the OAIC reference
Agencies and ministers
My agency has a number of matters with the OAIC and in some of these matters, the agency would like to change our decisions. What do we need to do?
Please write to foidr@oaic.gov.au include the relevant reference numbers. The OAIC will contact you to discuss the most appropriate way to progress the matter, including through making a revised decision (s 55G revised decision) or progressing the matter to a decision (s 55K IC review decision).
